These Terms of Service (“Terms”) govern your use of the websites, forms, online booking, SMS communications, gallery, wellness services, and other services operated by The 7 Space LLC, doing business as The 7 Space | Art Gallery & Wellness Center (“The 7 Space,” “we,” “our,” or “us”), a subsidiary program of Higher Lifestyle Corporation (a 501(c)(3) nonprofit organization, EIN 46-0670042). By using our websites, services, or facilities, you agree to these Terms. If you do not agree, please do not use our websites or services.
About us
The 7 Space LLC operates an art gallery and wellness center at 7 Warren Street, Newark NJ 07102. We operate under the brand umbrella of Higher Lifestyle Corporation, doing business as HigherSelf (the “HigherSelf Network”) as a subsidiary program providing art and wellness services to our community.
Use of our websites and services
You agree to use our websites and services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use. Prohibited uses include attempting to gain unauthorized access to our systems, interfering with site operation, harvesting personal information of other users, transmitting malicious code, or using our communications channels (forms, SMS, voice) to harass others or transmit unlawful content.
You must be at least 13 years of age to submit information through our websites. Bookings for wellness services may have additional age requirements as posted at the point of booking.
SMS terms
If you provide your phone number to one of our forms, our online booking system, or by calling our published business number, you consent to receive SMS messages from The 7 Space. Specific terms governing our SMS program are also described in our Privacy Policy:
- Message types: appointment confirmations, 24-hour and 2-hour reminders, missed-call auto-replies, RSVP confirmations, no-show follow-ups, and occasional event announcements to opted-in subscribers.
- Frequency: typically 1–6 messages per month per recipient.
- Cost: standard message and data rates may apply, charged by your wireless carrier. The 7 Space does not charge for SMS messages.
- Opt-out: reply STOP to any of our text messages at any time to immediately unsubscribe. Reply HELP for help.
- Carriers: we send SMS through Twilio, Inc. and through US carriers. Carriers are not liable for delayed or undelivered messages.
- No selling or sharing: we do not share your mobile number, message content, or opt-in consent with third parties for their marketing purposes.
Bookings, classes, retreats, and events
Bookings made through our online system are subject to the cancellation, rescheduling, and refund policies posted at the point of booking for each service. Wellness services are provided by independent practitioners working under our roof; specific therapeutic terms apply per practitioner. Workshop, retreat, and event tickets are non-transferable except as posted, and refunds are subject to the policy displayed at purchase.
Intellectual property
All content on our websites — including text, graphics, logos, images, and software — is the property of The 7 Space LLC, Higher Lifestyle Corporation, or our licensors, and is protected by United States and international copyright and trademark laws. “The 7 Space” is a trademark or service mark used by The 7 Space LLC. You may view and download content for personal, non-commercial use only.
User-submitted content
If you submit content to us — including artist applications, exhibition proposals, comments, or other materials — you grant The 7 Space LLC a non-exclusive, royalty-free license to review, store, and use that content for the purpose of evaluating and responding to your submission and operating our programs. You retain ownership of any creative work you submit, including portfolios, artist statements, and exhibition proposals. We do not claim ownership of artist submissions.
Third-party services
Our websites integrate with third-party services including Twilio (SMS), Beehiiv (newsletter), Stripe (payments), Amelia (booking), and others. We are not responsible for the content, terms, or practices of any third-party service. Your use of those services is governed by their own terms and privacy policies.
Disclaimers
Our websites and services are provided “as is” and “as available” without warranties of any kind, express or implied. Wellness offerings are for general well-being and are not a substitute for professional medical care. Information on our websites is for general informational purposes only and does not constitute medical, legal, tax, or financial advice.
Limitation of liability
To the fullest extent permitted by law, The 7 Space LLC, Higher Lifestyle Corporation, their directors, officers, employees, volunteers, and partner programs will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of our websites, services, facilities, or SMS communications.
Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or our services will be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you consent to the personal jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date at the top of this page.
